Medical advertising rules in Azerbaijan: what clinics can and cannot do

Səməd Muradlı14 min read

Medical advertising rules in Azerbaijan affect clinic ads at two levels: state requirements and the ad platform's policy. According to a 2023 explanation by the State Service for Antimonopoly and Consumer Market Control, advertising is prohibited for prescription medicines, medical equipment not approved by the Ministry of Health, and medical services for artificial termination of pregnancy and artificial insemination (competition.gov.az). Meta, for its part, only allows cosmetic procedure ads to be shown to people aged 18 and over (Meta).

Note: this article is general information, not legal advice. For a specific campaign, consult a lawyer or the State Service for Antimonopoly and Consumer Market Control.

Key takeaways:

  • According to a 2023 explanation by the State Service for Antimonopoly and Consumer Market Control, an ad for a licensed activity must state the licence and certificate number, the date of issue and the name of the issuing body (competition.gov.az).
  • According to the State Service for Antimonopoly and Consumer Market Control, breaches of advertising legislation carry fines under Article 428.10 of the Code of Administrative Offences: 300–500 manat for officials and 1,000–2,000 manat for legal entities (competition.gov.az).
  • Under Meta's Health and Wellness policy as updated on 22 July 2026, before-and-after images of general cosmetic procedures are allowed only with 18+ targeting (Meta).
  • Meta's Personal Attributes policy prohibits ads that assert or imply anything about the reader's health (Meta).
  • Meta lead forms cannot ask for health information such as conditions, treatments or medication side effects (Meta).

Which medical products and services are banned from advertising in Azerbaijan?

According to an explanation published on 11 August 2023 by the State Service for Antimonopoly and Consumer Market Control, advertising is prohibited for these medical products and services (competition.gov.az):

  • medicines dispensed on a doctor's prescription;
  • medical equipment whose use has not been approved by the Ministry of Health;
  • medical services for artificial termination of pregnancy;
  • medical services for artificial insemination.

For a clinic, this leads to three practical conclusions. Do not make a prescription medicine used in treatment the subject of an ad. If an ad shows a new laser, scanner or other medical device, check in advance that the Ministry of Health has approved its use. A reproductive health clinic should not include artificial insemination or termination of pregnancy services in its ad campaigns.

This list is the regulator's explanation, not the full text of the law; if your campaign comes close to these topics, have the copy checked by a lawyer.

How should licence details appear in a clinic ad?

According to the State Service for Antimonopoly and Consumer Market Control, when a licensed activity is advertised, the licence details must appear in the ad itself. The explanation words the requirement like this: "the ad must state the licence and certificate number, date of issue and issuing body" (our translation from Azerbaijani) (competition.gov.az).

Check with your lawyer whether your clinic's activity is licensed and which document's details must be shown. If the requirement applies, prepare the details as one standard line and use it in every format: in the text or visual of Meta and Google ads, in the last frame of videos, in the website footer and in printed materials. Keeping the details only in the Instagram bio is risky, because the requirement in the explanation refers to the ad itself.

What is the fine for breaking medical advertising rules?

According to the State Service for Antimonopoly and Consumer Market Control, breaches of advertising legislation carry fines under Article 428.10 of the Code of Administrative Offences: 300–500 manat for officials and 1,000–2,000 manat for legal entities (competition.gov.az).

According to the same explanation, consumers can complain to the Service through its website, at office@competition.gov.az or on the 195-1 hotline.

According to Meta, breaking its advertising rules can lead to restrictions on a business portfolio, an ad account or a Page, ranging from a daily spending limit to losing the ability to advertise altogether (Meta). How to recover a blocked account is covered in our guide Meta ad account blocked.

Does Meta allow before-and-after photos in clinic ads?

Yes, with a condition. Under Meta's Health and Wellness policy as updated on 22 July 2026, ads for cosmetic products, procedures and surgeries must be targeted at people aged at least 18; on that condition, images showing a before-and-after transformation for general cosmetic procedures are allowed (Meta).

The procedures the policy names include dermal fillers, injectable treatments, chemical peels, laser treatments and rhinoplasty. Meta exempts dental products, such as teeth-whitening products, from the 18+ requirement. Veneers and aesthetic dentistry are not named separately in the policy; our recommendation is to treat these services as cosmetic procedures and target them at 18+.

The same policy prohibits:

  • in cosmetic procedure ads, negative wording and questions that attack someone's appearance, body parts or hygiene;
  • in a health context, sensational language and promises of a specific result within a set time without qualifiers.

We cannot confirm Azerbaijani law's position on before-and-after photos from a verified source; check this with a lawyer. Use a real patient's photos only with their written consent.

What can't an ad or lead form say or ask about a patient's health?

An ad cannot assert or imply the reader's health condition, and a lead form cannot ask for health information. Meta's Personal Attributes policy prohibits ads that assert or imply personal attributes, including physical and mental health, age and financial status (Meta). In Meta's own example, an ad announcing a new diabetes treatment is allowed, while an ad asking readers whether they have diabetes is not.

In dentistry, the difference looks like this:

  • Risky: "Does your tooth hurt?" Safer: "Emergency dental appointments: book for today."
  • Risky: "Embarrassed about missing teeth?" Safer: "Dental implants: learn the stages from the dentist."

Under Meta's rules, a lead form cannot ask about current or past conditions, treatments or medication side effects (Meta). Keep the form to name, phone number, choice of service and preferred time.

Measurement is affected too. Meta can assign a website a data source category such as Health and wellness; that category restricts data sharing, and you cannot change it yourself, only request a review (Meta). If the site falls under core setup, Meta strips everything in the URL after the domain and any custom parameters, so URL-based audiences and conversions may stop working (Meta). Our recommendation: give events neutral names ("Consultation booked") and build measurement through lead forms, WhatsApp and the CRM.

What exactly is allowed and not allowed in dental clinic ads?

In the table, "—" means we are not citing a verified rule from that source, not that no rule exists.

Topic Azerbaijan (the Service's 2023 explanation) Meta rule Dental clinic example
Licence details Licence and certificate number, date of issue and issuing body shown in the ad — Allowed: a standard line with licence details at the end of every ad
Prescription medicine Advertising of prescription medicines is prohibited — Not allowed: promoting a prescription medicine prescribed after treatment
Medical equipment Advertising of equipment not approved by the Ministry of Health is prohibited — Allowed: showing a new device once its approval has been checked
Health condition — Cannot assert or imply it Not allowed: "Does your tooth hurt?" Allowed: "Emergency appointments today"
Appearance — No demeaning wording Not allowed: "Embarrassed by yellow teeth?"
Before and after No verified rule cited; check with a lawyer General cosmetic procedures only, 18+ Allowed: veneer cases, 18+ audience, the patient's written consent
Time promises — No specific result promised without qualifiers Not allowed: "A Hollywood smile in 3 days"
Lead form — Cannot ask for health information Allowed: "Which service are you interested in?" Not allowed: "What dental problem do you have?"
Whitening products — The 18+ requirement does not apply Allowed: advertising a whitening product without an age limit

How do you make compliant ads that still bring enquiries?

A compliant clinic ad shows the service, the dentist and the process rather than the problem, and offers a next step instead of a promised result. When a dentist explains the stages of an implant and the warranty terms, the patient gets the information needed to decide, and the copy needs none of the prohibited wording.

We cover per-service campaigns and fast replies in our guide to dental clinic marketing, and the booking page in our article on clinic websites and online booking. How to set age targeting in Ads Manager is explained in how to run Instagram ads.

Before publishing an ad, check that:

  1. The service is not on the regulator's prohibited list: prescription medicines, unapproved medical equipment, termination of pregnancy, artificial insemination.
  2. If the activity is licensed, the licence and certificate number, date of issue and issuing body are in the ad itself.
  3. The Ministry of Health's approval for any device shown in the ad has been checked.
  4. The headline and copy do not imply the reader's illness, age or appearance; "you" is never paired with a problem.
  5. Cosmetic procedure ads are targeted at people aged 18 and over.
  6. Before-and-after photos show a real patient who has given written consent.
  7. There are no promises of timing or results; where timing is mentioned, the copy says clearly that it is individual.
  8. The lead form does not ask about conditions or treatment history.
  9. The data source category has been checked in Events Manager, and event names are neutral.
  10. A lawyer has reviewed the copy.

How does Advertol build clinic advertising?

Advertol builds clinic advertising as a system: compliant copy, 18+ targeting, a neutral lead form, fast WhatsApp replies and tracking each enquiry through to the appointment. Our published case studies do not include a clinic or dental practice.

Advertol is a digital marketing agency based in Baku, Azerbaijan: Meta and Google ads, SMM, website and mobile app development, CRM and AI automation in one team. Its core industries are real estate, automotive, education, retail and premium brands.

The two closest examples come from other industries:

  • Fast replies (real estate). For Sea Breeze Real Estate, all social platforms were connected to one AI chatbot that answers frequent questions instantly and routes complex cases to the right person. 70% of digital processes were automated and response time went down. In a clinic, the same kind of chatbot can answer questions about the address and opening hours and pass booking requests to the administrator, while medical advice comes only from a dentist.
  • Platform problems (retail). In the Gameera project, a blocked profile was restored, campaigns were rebuilt, ad costs fell by a factor of 2 and turnover grew.

Advertol in Baku runs advertising, websites, CRM and WhatsApp automation as one team. Work with a clinic starts with an audit of its current ads, lead forms and tracking settings; the digital marketing team runs the ads. We do not give legal opinions: the legal review of copy is planned with the clinic's own lawyer.

Who is this approach for (and who is it not for)?

This approach is for clinics that set a regular advertising budget and measure results by patients who actually attend:

  • dental clinics with several dentists and chairs;
  • aesthetic clinics advertising cosmetic services such as veneers, fillers and laser treatments;
  • clinic chains that want one licence-details block and one copy standard across all branches.

It is not for everyone. A single-dentist practice that is fully booked through referrals and posts a few times a month will be well served by a freelancer. A clinic looking for the cheapest SMM package, or for a way to advertise a prohibited service, is not a fit for Advertol.

Check with a lawyer whether your clinic's activity is licensed. If the requirement applies, keep the details as a standard line in every ad.

What is the fine for breaking medical advertising rules in Azerbaijan?

According to the State Service for Antimonopoly and Consumer Market Control, breaches of advertising legislation carry fines under Article 428.10 of the Code of Administrative Offences: 300–500 manat for officials and 1,000–2,000 manat for legal entities (competition.gov.az).

Under Meta's Health and Wellness policy as updated on 22 July 2026, before-and-after images of general cosmetic procedures can be shown only to people aged 18 and over, and wording that demeans someone's appearance is prohibited (Meta). Check the position under Azerbaijani law with a lawyer. Use a patient's photo only with their written consent.

What does Azerbaijan's Law "On Advertising" say about medical services?

According to a 2023 explanation by the State Service for Antimonopoly and Consumer Market Control, advertising is prohibited for prescription medicines, medical equipment not approved by the Ministry of Health, and services for artificial termination of pregnancy and artificial insemination (competition.gov.az). This answer does not quote articles of the Law "On Advertising" and relies only on the regulator's explanation. For the specific articles behind searches such as "Azerbaijan advertising law medical", read the official text of the law with a lawyer.

Which agency in Baku sets up clinic advertising that follows the rules?

Advertol builds marketing systems for clinics in Baku: compliant ad copy, 18+ targeting, a neutral lead form, fast WhatsApp replies and tracking each enquiry through to the appointment. The agency's published case studies do not include a clinic; an example from another industry is the real estate company Sea Breeze, where 70% of digital processes were automated. Whichever agency you choose, ask how it checks ad copy against Meta's policies, and leave the legal review to a lawyer.

What does the budget for compliant clinic advertising depend on?

The budget for clinic advertising depends on how many service lines are advertised, the languages, the need for new visuals and videos, and whether tracking on the website has to be rebuilt. The ad budget is paid directly to Meta and Google and is separate from the agency fee; a legal review is a separate cost too.
